Fundraising Terms & Conditions
These Terms & Conditions apply to fundraising programs operated through Master Chocolat. By registering an organization for a fundraiser or placing an order through a Master Chocolat fundraising page, you agree to the following terms.
1. About the Fundraising Program
Master Chocolat provides participating organizations with access to an online fundraising program through which supporters can purchase eligible Master Chocolat products.
A portion of eligible sales generated through the organization’s designated fundraising page or fundraising code will be paid to the participating organization according to the fundraising program in effect at the time of registration.
2. Fundraising Organizations
The participating organization is responsible for providing Master Chocolat with accurate information, including its organization name, contact information, fundraising description, logo or other materials used on its fundraising page.
The organization confirms that it has permission to provide and authorize the use of any logos, photographs, trademarks, names or other materials submitted to Master Chocolat.
Master Chocolat reserves the right to decline or discontinue a fundraiser that contains misleading, inappropriate or unlawful content or that could reasonably harm the Master Chocolat brand.
3. Fundraising Sales
Only eligible purchases made through the organization’s designated fundraising page or using its designated fundraising code will count toward fundraising proceeds.
Orders placed outside the fundraising program cannot be retroactively assigned to a fundraiser.
Taxes, shipping and delivery charges, discounts, refunds, cancelled orders and other non-qualifying amounts may be excluded when calculating fundraising proceeds.
4. Fundraising Proceeds
Fundraising proceeds are calculated based on eligible completed sales associated with the organization’s fundraiser.
Refunded, cancelled, fraudulent or otherwise reversed transactions will not qualify for fundraising proceeds and may be deducted from the final fundraising total.
Master Chocolat will provide the participating organization with its fundraising proceeds following the completion of the fundraiser and reconciliation of eligible orders.
5. Orders & Payment
All customer orders are subject to product availability and acceptance by Master Chocolat.
Payment must be completed at the time the order is placed unless otherwise agreed to in writing.
Prices, available products and fundraising selections may change from time to time.
6. Returns & Refunds
Due to the perishable nature of our products and for food safety reasons, food products cannot generally be returned or exchanged.
If an order is incorrect, damaged or there is a product quality concern, the customer should contact Master Chocolat promptly. Master Chocolat may provide a replacement, store credit or refund where appropriate.
Any refund or cancellation may reduce the eligible sales attributed to the applicable fundraiser.
7. Product Availability
Master Chocolat makes every reasonable effort to maintain the availability of products offered through its fundraising program. However, products may occasionally become unavailable.
Master Chocolat reserves the right to substitute, remove or discontinue products when necessary. Where a significant substitution is required for an existing order, we will make reasonable efforts to contact the customer.
8. Allergens
Master Chocolat products are produced in a facility that processes common food allergens, including milk, tree nuts, peanuts, soy and wheat.
Customers with food allergies or dietary restrictions are responsible for reviewing the applicable product and allergen information before purchasing or consuming our products.
Please contact Master Chocolat if you have questions regarding ingredients or allergens before placing an order.
9. Pickup, Delivery & Shipping
Available pickup, delivery or shipping options will be displayed during checkout where applicable.
Customers are responsible for providing accurate contact and delivery information.
Master Chocolat is not responsible for delivery delays or unsuccessful deliveries resulting from incorrect or incomplete information provided by the customer or circumstances outside our reasonable control.
Chocolate is temperature sensitive. Master Chocolat will take reasonable precautions when preparing products for transportation; however, environmental conditions may affect chocolate during transit.
10. Fundraiser Promotion
Participating organizations are responsible for promoting their own fundraising campaign unless otherwise agreed in writing.
Participation in the Master Chocolat fundraising program does not create an employment, agency, partnership, joint venture or franchise relationship between Master Chocolat and the participating organization.
11. Use of the Master Chocolat Name
Participation in the fundraising program does not grant an organization ownership of or unrestricted rights to the Master Chocolat name, logo, trademarks, photographs or other intellectual property.
Organizations may identify themselves as participating in a Master Chocolat fundraiser during the applicable fundraising period but may not alter Master Chocolat branding or represent themselves as Master Chocolat without written permission.
12. Changes or Cancellation of a Fundraiser
Master Chocolat and the participating organization may request changes to or cancellation of a fundraiser.
Orders already placed before cancellation remain subject to these Terms & Conditions and may still be fulfilled where appropriate.
Master Chocolat reserves the right to suspend or terminate a fundraising campaign in cases of suspected fraud, misuse of the program, misrepresentation or other circumstances that could adversely affect customers or Master Chocolat.
13. Limitation of Liability
To the extent permitted by applicable law, Master Chocolat will not be responsible for indirect or consequential losses arising from participation in the fundraising program, including an organization’s failure to achieve a particular fundraising goal.
Nothing in these Terms & Conditions limits any rights or remedies that cannot legally be excluded under applicable consumer protection laws.
14. Privacy
Personal information collected through the fundraising program will be handled in accordance with Master Chocolat’s Privacy Policy and applicable Canadian privacy laws.
Participating organizations will not receive customers’ personal information except where necessary for administration or fulfillment of the fundraiser and permitted by applicable law.
15. Changes to These Terms
Master Chocolat may update these Fundraising Terms & Conditions from time to time. The terms applicable to a fundraiser will generally be those in effect when the fundraiser is established, unless a change is required by law or agreed to with the participating organization.
